GDSs ASK WHEN AND HOW MUCH ,BUT IT IS THE TIME TO BE UNITED FOR PROPER PRESENTATION BY APPROPRIATE LEADERSHIP AND HARD WORK FOR UNION SAKE.
Comrades to fight against these policy’s, the both the members of the union / association and the leadership should be more serious in their approach. Now are never , organize and educate each and every worker / employee .
Save our Jobs for better future of our children.

Comrades,
Article 309 & 311 of the
Constitution(both) are related to Central Government employees.
GDS Conduct
& Engagement Rules, 2011 were not framed under Article 309 of the
Constitution of India but under *executive powers (Arbitrary invasion) of
Central Government* after approval of the recommendations of the Nataraja
Murthy Committee report. Thus these rules are also non statutory in nature.
Why they are
not interested to amend or withdraw the executive resolution?
Where Part
III of the constitution is to provide protection to the freedoms and rights
mentioned therein against arbitrary invasion by the State.
Article 309 of
Constitution is controlled by the Doctrine of Pleasure embodied in Article 310.
Article 309 make it clear that “Conditions of service whether laid down by the
legislature or prescribed by the Rules must conform to the mandatory provisions
of the Constitution as laid down in Articles 310,311 and 320 or in Part III of
the Constitution.
These Rules should
also satisfy such conditions as “EQUAL PAY FOR EQUAL WORK” under Article 39(d).
The power to frame
rules under Article 309 includes the power to Amend or Alter the Rules with
retrospective effect to the principle, that the benefits acquired the existing
rules cannot be taken away by the retrospective effect.(Expressed by Supreme
Court in T.K.Kapur v.State of
Haryana,1986 Supp.S.C.C. 584)
So in the present scenario the Department of
Post can’t take away the provision to the GDSs more fairly should allow the
GDSs Civil Servant status with provision of statutory pension to the GDSs
joined before 2014 and retiring after serving humbly more than 10 Years, on
social security to them.
Otherwise the Fundamental Rights contained
in Article 14 ,15,and 16 of the
Constitution for the said GDSs in the Country would be forcefully deprived of by
the welfare State like Great India.
At this juncture,
Directorate must convince the Govt.of India consulting the
departmental legal wing and do favor to 2,70,000 GDS and their families offering Civil Service Status to the GDSs.

My dear comrades,
The days are passing by, just listening to the odds(vakwas) of the so called recognized leaders .If they would have some thing to do on the issue of GDSs then GDSs would not be victimized so, facing delay of getting their legitimate due of salary and job condition .The innocent GDSs are exploited both by the employer and the false committing Union Leaderships ."Hum chitthi Likha hey bhai" is their crocodile tear to milch the union fund from the concerned innocent GDSs. Shame to them,who are instigating the GDSs to go for strike again and again on the same issue losing their hard earn for their family.What happens this day ask them .Only one option for the GDSs to follow 'intezaar'. As-if the Govt. is going to pass the budget earlier this year probably on November 2017 our patience is to be kept solaced till then .So may I request my Comrades not to be worried till the Session Budget of November when our financial expenditure would be passed in the parliament .Because the seventh Pay Commission ignoring the GDSs has fallen in about 13000 crore deficit to the Department,just ignoring the real earning hands of the Postal Department,i.e.GDSs.
Who would let make out the fact to the Government ,whether the crowned Union leadership or not ? But they have no time out of attending Divisional /Circle meetings to publish the blog pages with their photos .
Therefore I invite the real thinkers of the GDSs fraternity to swear to avoid the the traditional Recognized GDSs Union to save the career of GDSs .
Because the present scenario is not traditional ,but more inventive or renovating "Chitthi likha hey bhai" ,is the old tricks to fool the GDSs. Leave this nonsense trick of Union activity not to cheat the GDSs.

Post is approaching nearer
which reads as “India Post will be a socially committed, technology driven,
professionally managed and forward looking organisation.”
Then......
could the role of GDS be ignored ?
If no ....Then why in such a vast country like 'BHARAT' the reluctance sooooooooooo to pay the GDSs is an ambiguity.

o The minimum wage has been increased to Rs. 10000/- per month and maximum pay to Rs. 35480/- per month.

o The rate of annual increase is recommended as 3%.
o A Composite Allowance comprising of support for hiring accommodation for GDS Post Offices as well as mandatory residence, office maintenance, mobile and electricity usage charges etc. has been introduced for the first time.
o Children Education Allowance @Rs. 6000/- per child per annum has been introduced for GDSs.
o Risk & Hardship Allowance @Rs. 500/- per month for GDS working in the special areas has also been introduced.
o A Financial upgradation has been introduced at 12 years, 24 years and 36 years of services in form of two advance additional annual increases.
o The Ceiling of ex-gratia gratuity has been increased from Rs. 60,000 to Rs. 5,00,000
o The GDS Contribution for Service Discharge Benefit Scheme (SDBS) should be enhanced maximum up to 10% and minimum up to 3% of the basic wage per month, whereas the Department should contribute a fixed contribution of 3% of the basic wage of the GDSs.
o The coverage of GDS Group Insurance Scheme has been enhanced from Rs. 50000/- to Rs. 5,00,000/
o The contribution of Department in Circle Welfare Fund (CWF) has been increased from Rs. 100/ per annum to Rs. 300/ per annum.
o The scope of CWF is extended to cover immediate family members such as spouse; daughters, sons and dependent daughters in law in the scheme.
o The Committee also recommended 10% hike in the prescribed limits of financial grants and assistances in the Circle Welfare Funds.
o The Committee has recommended addition of Rs. 10,000/ for purchase of Tablet / Mobile from the Circle Welfare in the head “Financial Assistance of Fund by way of loans with lower rate of interest (5%)”.
o Provision of 26 weeks of Maternity Leave for women GDS has been recommended.
o The wages for the entire period of Maternity Leave is recommended to be paid from salary head from where wages of GDSs are paid.
o The Committee has also recommended one week of paternity leave.
o Leave accumulation and encashment facility up to 180 days has been introduced.
o Online system of engagement has been recommended.
o Alternate livelihood condition for engagement of GDSs has been relaxed.
o Voluntary Discharge scheme has been recommended.
o The Discharge age has been retained at 65 years.
o The Limited Transfer Facility has been relaxed from 1 time to 3 times for male GDSs. There will be no restriction on number of chances for transfer of women GDSs. The powers for transfer has been delegated to the concerned Divisional head.
o The ex-gratia payment during put off period should be revised to 35% from 25% of the wage and DA drawn immediately before put off.
o The Committee has recommended preferring transfer before put off duty.

New System Of Membership Verification for recognition of GDS service Unions.
■DoP is introducing a new system for verification of GDS in which new Declaration form previously numbered will be sent to each employees by the Divisional Head who will fill up,sign it,and drop it in the Divisional office in a separate box.
■understand this is to avoid dual decoration submission.
■DoP is likely to call a meeting with General Secretaries of GDS Unions to discuss the matter.
Formal notice will be issued shortly.
