Applying the above principles to the present case, the violation of the principle is quite apparent in this case as the respondent No. 4 to whom the applicant was alleged to have misbehaved, had decided to function as the 13 disciplinary authority against the applicant instead of referring the matter to the next higher authority for taking an appropriate decision in the matter. Here the disciplinary authority himself had complained of being misbehaved by the applicant, which was included as one of the charges. 18. As a result, we have no hesitation to allow the OA by quashing the charge-sheet dated 9.4.2008 (Annexure-A/1). As a consequence, the punishment order dated 30.8.2011 (A/8), order dated 27.6.2012 of the appellate authority (Annexure-A/11) and the order dated 22.5.2013 (A/13) of the revisionary authority are also set aside and quashed. The applicant is to be reinstated in his engagement as GDS with all consequential benefits including the TRCA for the period he was out of the engagement due to the order of dismissal. The respondents will be at liberty to initiate the proceedings against the applicant afresh in accordance with law. The OA is allowed accordingly with no order as to cost. A FAVOURABLE ORDER FOR THE GDSs
OA 749/2015 with 2 connected OAs
the law in this regard that the Tribunal should not venture into
deciding pay scales and service conditions as these are within the
domain of the executive and is best left to be decided on the basis of
recommendation of expert bodies, such as, Pay Commissions
[Union of India & Another Vs. P.V. Hariharan and Another, 1997
SCC (L&S) 838 and Union of India Vs. Makhan Chand Roy, AIR
1997 SC 2391]. This prayer is, therefore, rejected.
20. To summarise, we dispose of the O.As. with the following
directions to the respondents:
(a) For all Gramin Dak Sevaks, who have been absorbed as regular Group ‘D’ staff, the period spent as Gramin Dak Sevak will be counted in toto for the purpose of pensionary benefits.
(b) Pension will be granted under the provisions of CCS (Pension) Rules, 1972 to all Gramin Dak Sevaks, who retire as Gramin Dak Sevak without absorption as regular Group ‘D’ staff, but the period to be counted for the purpose of pension will be 5/8th of the period spent as Gramin Dak Sevak. Rule 6 will accordingly be amended.
(c) The Gramin Dak Sevaks (Conduct and Engagement) Rules,
2011 are held to be valid except Rule 6, as stated above.

(d) The claim of Gramin Dak Sevaks for parity with regular
employees regarding pay and allowances and other benefits
available to regular employees, stands rejected.
21. With the above directions, all the three O.As. stand disposed

Cabinet approves release of an additional installment of DA to Central Government employees and DR to Pensioners, due from 1.1.2019

The Union Cabinet chaired by Prime Minister Narendra Modi has given its approval to the release of an additional instalment of Dearness Allowance (DA) to Central Government employees, and Dearness Relief (DR) to pensioners w.e.f. 1.1.2019 representing an increase of 3% over the existing rate of 9% of the Basic Pay/Pension, to compensate for price rise. This increase is in accordance with the accepted formula, which is based on the recommendations of the 7th Central Pay Commission (CPC). The combined impact on the exchequer on account of both DA and DR would be Rs. 9168.12 crore per annum and Rs. 10696.14 crore in the FY 2019-20 (for a period of 14 months from January 2019 to February, 2020).This will benefit about 48.41 lakh Central Government employees and 62.03 lakh pensioners.

Notice is hereby given that an emergent Central Council Meeting of the Union
will be held from 26th to 27th January 2019, at Jagannath
Dham, Puri near Badadanda Dharma sala, Odisha .The Meeting will start at 11AM
sharp on 26th January 2019, and conclude business by evening of 27th
January. In order that a larger
representation and broader exchange of views is anticipated ,it is further
proposed that his Meeting be termed as
enlarged meeting of the council and be attended by all Divisional leaders of
this Union in the Country. It is clarified that CHQ will be making arrangements
for food and stay of the attending members, the concerned respective delegations
will bear their own expenses.
The following shall be the Agenda
for the enlarged Meeting –
1 .Organizational review:
(i)Position of the Organization
at all levels - comparative position with other Unions and required efforts to
be made for enhancing membership.
(ii) Distribution of
responsibility to the Leaders in all the Circles, for implementing the Union’s
ideology, by giving proper information to the leaders and cadres in a way of
refresher’s course of an ideal Union.
(iii) Discussion on fund management in humble
way by the leaders unlike the other Unions do.
(iv) listening the debate “why
should we barely need immediate Departmentalization” and how the acting GDS
Unions are incapable of representing GDSs by a match fixing with Departmental
interference, rather not convincing parliamentarians, the actual reality of
GDSs at grass root level in relation to department.
(v) How we assess the 7th
Pay Kmalesh Ch Committee and how to take further concrete steps for
Departmentalization.
(vi) The resolution points to be
taken for Dak Bhawan and separate for Ministry of Communication.
(v) Any Other matter with
permission of the Chair.

Cabinet approves Amendment to the Trade Unions Act, 1926 to make provisions regarding Recognition of Trade Unions
The Union Cabinet chaired by Prime Minister Shri Narendra Modi has approved Amendment to the Trade Unions Act, 1926 to make provisions regarding Recognition of Trade Unions.
Benefits:
- The approval will facilitate:
- Recognition of Trade Unions at Central and State level;
- Ensure true representation of workers in the tripartite bodies;
- Check on the arbitrary nomination of workers’ representatives by the Government; and
- Reduce litigation and industrial unrest.
- The proposed Bill will ensure that the nomination of workers’ representatives in tripartite bodies by the government will become more transparent. Trade Unions so recognized would be accountable in maintaining industrial harmony. Recognition of Trade Unions at Central/State level would reduce duplicity of such exercise by different departments. Recognized Trade Unions may be assigned specific roles at Central or State level.
