LANDMARK JUDGMENT BY SUPREME COURT FOR PAYMENT OF “EQUAL PAY FOR EQUAL WORK” TO THE DAILY WAGE EMPLOYEES, ADHOC APPOINTEES, EMPLOYEES APPOINTED ON CASUAL BASIS, CONTRACTUAL EMPLOYEES AND THE LIKE.

The Hon’ble Supreme Court in its Historical 102 pages Judgment in Civil Appeal No. 2013 of 2013 dated 26.10.2016 has directed that Temporary Employees, Adhoc Appointees, employees appointed on Casual basis, contractual employees and the like, if the concerned employees are rendering similar duties and responsibilities as were being discharged by regular employees holding the same/corresponding posts are entitled “for equal pay for equal work” such employees are entitled for draw wages at the minimum of the payscale extended to regular employees holding the same posts.

 I wish a concrete unity of GDS just to face the hazards of any unfavorable Pay Committee Report for GDSs in future .


Meaning of ex gratia
 (ˈɡreɪʃə)
adj
given as a favour or gratuitously where no legal obligation exists: an ex gratia payment.[New Latin, literally: out of kindness]
* When a R.P.L.I. Mela is conducted,the GDS workers are pressurized practically to enhance the business,from the Dept.
* When the matter of Opening of large No.of SB A/C comes GDS are pressurized practically for their obligation of productivity of profit of the Dept.
* When other almost same Items/ services of the Dept. are responsibly furnished by the GDSs,even not taking their time in relation to their Allowance he GDSs are victimized and designated as special category of employees in the Dept.
            The profit yielding about 3,00,000 forces of the Postal Department is expelled from Productive Linked Bonus. and allotted Ex gratia Bonus.
     Question comes ,Why ???
I think it is Due to the incompetent  GDSs Leadership and the Crocodile tear of Federation .Because I saw a blog of some federal Union who stated "

          Can the Comrade of this blog can say please the Bonus Amend Rule 2015 vied Bill No.265-C of 2015 has denied the DOP  to pay in enhanced rate to the GDSs of his Establishment ???
        Does the Rule imply to discriminate the Bonus Rule for the GDS who are actually the Productive yielding force of the Department? 
       Then why the GDSs have to struggle for their legitimate implied Right?
       Why the GDS Leader and the Federation Leaders give Account of their struggle competing with one another showing their respective credits.
       The fact of cause for this situation is only the innocence and long time tolerance of harassment/ leadership tricks of the GDSs having no further hope from the Leadership level.
           When work/business is taken by the Department on demand from the GDSs, Why the Bonus is given, out of kindness ??
             Should we not find the way to abolish this system of Ex -Gratia Bonus and Substitute with Productive Linked Bonus for GDSs??
            The way is there ,But The only recognized Union is unaware and impose only an unproductive strike risk on the common GDSs.
         If the GDSs would always carry the risk of all hazard, then why the Leders are appointed and paid trvelling allowances ?
           If the Union Fund Dose not permits for a small Court case expense for admin.to challenge,then dose the fund is miss-utilized by the Leadership ??
          Taking all the points in view I propose the Common GDS to leave the conventional leadership and onset a new spirit of unity to solve these type of matters promptly in the innovative way and strengthen the unity by joining in ADVANCED RURAL POSTAL EMPLOYEES UNION. 
      I wish a concrete unity of GDS just to face the hazards of any unfavorable Pay Committee Report for GDSs .For this please collect Funds at your SO level as we have got our arrears Bonus/DA and keep uninterrupted touch with our Unity .

  BONUS ORDER ISSUED THIS DAY AFTER RE-SANCTION FROM THE CABINET,AS STATED BY THE DEPT AND PERHAPS  FOR EVERY AMENDMENT BY THE G.O.I.THE FATE OF GDS HAVE TO FOLLOW THE SAME GAME AS BY THIS TIME OCCURRED.THIS IS ONLY DUE TO THE WEAK LEADERSHIP AT THE CENTRE FOR GDS .THE FIERCE OF STRIKE NOTICE IS NOT THE SOLUTION ,RATHER IT WAS THE POLITICISATION OF THE FACT BY THE WEAK LEADERS TO COLLECT THEIR SUBSCRIPTION IN THE NAME OF STRIKE EXPENSE ,JUST REALISE IT AND FOR STRONG UNITY ,JUST AVOIDING THE WEAKEN LEADERSHIP AT CENTRE, TRY TO ESTABLISH A HUGE PERSONALITY UNLIKE THE LEADER OF TRICKS AND DRAMATIC TENDENCY ,WHO DON'T GIVE PRIORITY AT ALL TO THE COMMON GDS ,RATHER THE SUBSCRIPTION COLLECTING AGENTS OF HIS CHOICE ,OR ELSE AFTER GETTING THE GOOD PAY COMMITTEE REPORT AGAIN THE DRAMATIC TRICKS OF THE CONVENTIONAL LEADERS WOULD START,TO FELL YOU ALL, IN ILLUSION.

              CABINET APPROVES RELEASE OF AN INSTALMENT OF DEARNESS ALLOWANCE TO CENTRAL GOVERNMENT EMPLOYEES AND DEARNESS RELIEF TO PENSIONERS DUE FROM 01.07.2016 
            The Union Cabinet under the Chairmanship of Prime Minister Shri Narendra Modi has given its approval to release an instalment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to Pensioners w.e.f. 01.07.2016 representing an increase of 2% of the revised Basic Pay/Pension, to compensate for price rise. The increase is in accordance with the accepted formula, which is based on the recommendations of the 7th Central Pay Commission.


            The combined impact on the exchequer on account of both Dearness Allowance and Dearness Relief would be Rs. 5622.10 crore per annum and in the Financial Year 2016-17 for the period of 8 months (i.e. from July 2016 to February 2017), it would be Rs.3748.06 crore.   Think! By strike wouldn't we lose the 14-15 arrear,like 2007 Amendment?
                Where proper interpretation of the Bonus Amendment rule 2015(vide-Bill No-265-C 2015 in Parliament) is enough to achieve the enhanced Ceiling  for GDS with arrear.By Legal order even the short payment of 3500/- Ceiling from 2007 Amendment Rule may be achieved.
                   Is it wise to go for Strike considering two days no pay?
                  Rather it is wise to solve the problem for ever by a Court Order in favour of GDSs regarding this issue.
                  As the Amendment of enhancement has been done by the GOI, (if analysed and interpreted to the Bonus Amendment Rule).
                 But not implemented by the DOP.
     Hence think appropriate before taking decision.

As part of its ongoing efforts to be more tech-savvy and refine its approach in service delivery, the Department of Posts now has twitter accounts and launched a toll-free complaint number —1924. Besides mailing grievance letters to the department, customers may tweet their complaints to @cpmgtamilnadu and @pmgchennai.

Leave the wrong policy of MAHADEVAIAH,to go for strike again and again just begging to the genuine demand of the GDSs before the Dept. who is actually over looking the GDS ,it is the out dated weak policy of the only defective Leader  ever and come to join our Union i.e. ARPEU to hit at the target where necessary. 
Make the 12th Oct. GB Meeting success at Balasore to take a concrete Resolution on the present scenario.

                     Bonus orders issued by the Department to all Heads of Circles today for 60 days.
While the case of bonus to GDS in enhanced rate @7000 is under consideration with the Finance Ministry,the Dept. of Post has passed the bonus Order to GDS in old Rule @3500/-is now yet to be decided and we may get the arrear in future.If the Department deprives us of the Bonus Amendment Rule 20015,vide Bill no 265-C  of 2015 then we have to file a tribunal against it.So be prepared for our legitimate due for the same and no compromise as other Union leaders do.

     All the supporter to my proposal for the Bonus issue are requested to attend the meeting on 12 and 13th october(Muharrum) at Balasore to take a concrete resolution on this.Please don't miss this occasion,and Contact -
